The State says Board Members can no longer keep secrets

SB751 of 2013 has amended Section 54953 of the Government Code. The Code is in relation to the Ralph M. Brown Act which prohibits taking action by secret ballot.  SB 751 has reached in a little further and now requires “the legislative body of a local agency to publicly report any action taken and the vote or abstention on that action of each member present for the action.”

Public Agencies which hold meetings governed by the Brown Act should ensure that they are correctly recording and publishing the votes of its members.
